Dynamic footer snippet appears in both Default & Segment

First, we use a custom double opt-out unsubscribe for our enewsletters. (We don't use the system unsubscribe.)

I've built a custom HTML template with two dynamic blocks: at the top and in the footer.

• Prospects will see in the dynamic block 1, "Opt-in to get more timely tips like these." (segment built & associated for the non-subscribers)
  

   

• Subscribers will not see dynamic block 1 but will see the custom opt-out in dynamic block 2. (segment default is associated with subscribers)
• Prospects will not see the custom double opt-out in the footer.

Problem: Both the default (subscribers) & segment (non-subscribers) show the unsubscribe info.
