Issue with the "Not Had Interesting Moment Filter"

I am trying to limit the number of times an IM can fire to twice per day. Currently, this is how I have the "Not Had Interesting Moment" filter set up:

However, I'm still seeing more than two of these fire for a single person in a day. Is there any issue with this logic? As far as using the min number of times and date of activity constraints?

UPDATE: Inactivity filters cannot be used with "Min. Number of Times" constraint. Marketo doesn't understand how to have NOT done something a minimum number of times. Can either set up custom score model, or reference a separate smart list to achieve goal here.

Confused why this is an option in the drop down on this filter.
